An essential guide for fertility specialists and embryologists on compliance, registration, clinic level accreditation, and reporting under the Indian ART Act.

The enactment of the Assisted Reproductive Technology (Regulation) Act, 2021 and the Surrogacy (Regulation) Act, 2021 has ushered in an era of strict accountability and transparency across India’s fertility landscape. The National ART & Surrogacy Portal serves as the central statutory registry for all Level-1 and Level-2 ART clinics and ART banks.

Level 1 vs Level 2 ART Clinics

Under statutory definitions:

  • Level 1 ART Clinic: Authorized solely to conduct IUI procedures and diagnostic semen evaluation.
  • Level 2 ART Clinic: Fully equipped for advanced assisted reproduction—including ovum retrieval, ICSI, embryo culture, blastocyst vitrification, and embryo transfer.

Mandatory Qualifications for Embryologists

The Act mandates that practicing embryologists possess verified postgraduate medical or science qualifications alongside recognized practical training in accredited institutes.
